JetBlue 1112 departs at 1640, so at least visability was good neough to see them, if they were operating without a transponder most likely their TCAS was in standby as well. Which means the flight crew would not have received a TCAS traffic or resolution advisory..
Had this been at night, there is a chance the military aircraft would have also been operating without navigation lights, which most likely would have resulted in a collision.
There really needs to be better guidlines for military aircraft, either fixed wing or rotary operating in a terminal area. IE, unless opsec dictacts to either use VHF to communicate with ATC, or have the UHV frequencies crossbanded to VHF for better situational awareness by other pilots. Now it appears unless operating in a published MOA or again OPSEC dictates, they must be squawking a transponder.
The incidents of military vs. civilian aircraft seem to be increasing..
